Redundancy: the sequence that keeps a programme defensible
Redundancy claims are usually won on paperwork produced before anyone was told. Build the business case, then the pool, then the timetable, and only then start speaking to employees.
The order of work
- Write the business case: what work is reducing, by how much, and why.
- Decide the pool of employees doing interchangeable work, and record why the boundary sits where it does.
- Choose objective selection criteria and prepare the scoring matrix before any names are attached.
- Count the proposed dismissals to decide whether collective consultation and form HR1 are triggered.
- Build the timetable backwards from the earliest lawful dismissal date.
- Announce, consult, score, share scores, hear challenges, then confirm outcomes with a right of appeal.

Costs to budget for
- Statutory redundancy pay for anyone with two years' service, or any enhanced scheme you are contractually bound to.
- Notice pay, either worked or paid in lieu, plus accrued holiday.
- Any settlement agreement payments and legal fee contributions where you want a waiver of claims.
- Outplacement support, which is optional but reduces the number of claims materially.
- Management time. A 20-person programme typically absorbs several weeks of senior time.
Alternatives worth testing first
- Recruitment freeze and ending agency or contractor use.
- Voluntary redundancy or voluntary reduced hours, which lowers the risk of selection challenges.
- Redeployment across the group, including at other sites.
- Temporary lay-off or short-time working where the contract allows it.
- Being able to show these were considered strengthens the reasonableness of the eventual dismissals.
Special protections
Employees who are pregnant or who have recently taken maternity, adoption or shared parental leave have priority for suitable alternative vacancies, and that protection now extends well beyond the end of leave. Identify them before you start scoring.
