Constructive Dismissal
When an employee resigns in response to a fundamental breach of contract by their employer, treating the resignation as a dismissal.
Gross Misconduct
Conduct so serious it justifies summary dismissal without notice or pay in lieu of notice.
PILON (Payment in Lieu of Notice)
A payment made to an employee instead of requiring them to work their notice period.
Redundancy
A statutory definition: dismissal because the employer needs fewer employees to do work of a particular kind, or has closed a workplace.
Settlement Agreement
A legally binding contract in which an employee agrees to waive employment claims, usually in exchange for a payment.
TUPE Transfer
The automatic transfer of employees and their terms and conditions when a business or service provision moves from one employer to another.
Unfair Dismissal
A dismissal that is not for one of the five statutory fair reasons, or that follows an unfair process.
